Understanding the FMCSA Clearinghouse: How to Stay Compliant and Protect Your Authority

A simple guide to the essential driver drug and alcohol tracking system.


As a fleet owner or owner-operator, compliance isn’t optional it’s the backbone of your business. One of the most critical compliance areas monitored by the FMCSA is the Commercial Driver’s License (CDL) Drug and Alcohol Clearinghouse. Failing to properly use this system can lead to severe fines, driver suspensions, and can even put your operating authority at risk.


To keep your operations running smoothly and ensure your drivers are fully qualified, keep these three essential rules in mind:


  • 1. Conduct Pre-Employment Queries: Before you let a new hire drive a commercial motor vehicle (CMV), you must conduct a full query in the Clearinghouse. This verifies that the driver doesn't have any unresolved drug or alcohol violations that prohibit them from operating.

  • 2. Run Annual Queries for Current Drivers: Compliance is an ongoing process. You are required to query the Clearinghouse at least once every 12 months for all CDL drivers currently on your payroll.

  • 3. Report Violations Promptly: If a driver tests positive on a drug test or refuses to take one, as an employer, you are legally obligated to report this violation to the Clearinghouse within 3 business days.
